He said staff recommendation is <br />adoption of the resolution. <br />It was moved by Holt, seconded by Lange, and carried 3-0 to adopt <br />Resolution No. 051106-B directing preparation of the Engineer's Report, <br />declaring the District's intention to levy assessments for 2006-07, <br />preliminarily approving the Engineer's Report for Districtwide Park <br />Maintenance and Recreation Improvement District (62-1) and providing <br />for a notice of public hearing; that it be read in title only and all other <br />readings be waived. <br />C. Approval Of Memorandum Of Understanding Involving City Of Thousand <br />Oaks, Conejo Valley Unified School District, Conejo Recreation & Park <br />District And Shapell Industries Regarding Lot 11 and Lot 2 Within <br />Rancho Conejo <br />Ward stated that the submitted Memorandum of Understanding (MOU) sets <br />forth terms of a four party agreement which provides benefits to each of the <br />parties. The City is to acquire a site adjacent to the Municipal Service Center <br />from Shapell; the School District is to receive funds from the sale of its <br />property (Lot 2); the Park District is involved in the transaction because Lot 2 <br />(the former Conejo Valley High School relocation site) has a Deed Restriction <br />which provides that any future sale of Lot 2 for private use requires payment of <br />a park fee equal to 50% of the value of the property; Shapell is purchasing a <br />property (Lot 2); and the City and School District adopted similar resolutions <br />on May 9. <br />In response to Kathy Carlson's concerns and questions, Ward and Friedl <br />clarified the surplus property process and provided background information. <br />It was moved by Holt, seconded by Jacobsen, and carried 3-0 to <br />authorize the General Manager to execute the submitted Memorandum of <br />Understanding (MOU) and all documents necessary to carry out the <br />terms of the MOU. <br />D.
