7. LUCY PET shall at all times during usage period maintain at its own cost and expense
<br />Public Liability insurance covering liability for bodily injury, personal injury, death, and
<br />property damage. The DISTRICT, CVUSD, and City of Thousand Oaks (CITY) shall be
<br />named as additional insureds, and shall receive a copy of the certificate thirty (30) days
<br />prior to the event if obtainable, and if not obtainable, LUCY PET and/or DISTRICT may
<br />cancel Conejo Valley Days celebration. The amount of insurance coverage shall be
<br />$1,000,000 per occurrence and $2,000,000 aggregate.
<br />8. LUCY PET hereby indemnifies and holds the DISTRICT, CVUSD and CITY and its
<br />officers, officials and employees, harmless from and against any and all claims by or on
<br />behalf of any person or persons, firm or firms, corporation or corporations arising from
<br />any negligent act or omission either under this Agreement or in or on adjacent parking
<br />areas used for the celebration, by LUCY PET or any of its contractors, servants,
<br />employees, permittees, or agents, from and against all costs, attorney fees, expenses, and
<br />liabilities incurred in or about any such claim, action, or proceeding brought thereon. All
<br />parties contracted for the event who have their own insurance shall be required to name
<br />the DISTRICT, CVUSD and CITY as additional insureds. Notwithstanding anything to
<br />the contrary herein, if LUCY PET maintains insurance as agreed to in the preceding
<br />paragraph of this Agreement, the District will look solely to that insurance, and not to
<br />LUCY PET, for recovery of all amounts due from LUCY PET and claims against LUCY
<br />PET relating in any way to Conejo Valley Days, this Agreement, the indemnity given by
<br />LUCY PET under this Agreement, and for loss or damage arising out of or relating in any
<br />way to this Agreement, provided that LUCY PET shall be liable up to the amount of any
<br />deductible or self-insured retention, but not for any amount in excess of such deductible
<br />or self-insured retention.
<br />9. The DISTRICT hereby indemnifies and holds LUCY PET and its officers, officials and
<br />employees, harmless from and against any and all claims by or on behalf of any person or
<br />persons, firm or firms, corporation or corporations arising from acts of negligence of the
<br />DISTRICT or any of its agents, contractors, servants, employees, permittees, or agents
