The resolution under <br />consideration confirms and approves the final Engineer's Report for LMD <br />94-1 and confirms the levies of $217.56 per single family unit, which are <br />within the allowable range. <br />It was moved by Lange, seconded by Short, and carried 5-0 to adopt <br />Resolution No. 043009-B, ordering the levy of assessments for LMD <br />94-1 (Dos Vientos); that it be read in title only and all further readings <br />be waived. <br />C. Field Restoration and Holdover Performance Bond for Community <br />Carnival at Conejo Creek South Park <br />Friedl reviewed past relevant information. He stated that on March 26, <br />2009 the Board approved the use agreement and conditions for a large <br />scale community carnival at Conejo Creek South Park with Joe Blash, <br />President of North American Amusements, dba Shamrock Shows. As a <br />condition of approval, the Board requested the operator secure a $50,000 <br />performance bond. Arthur J. Gallagher Risk Management Services, Inc. <br />requests the bond be lowered to $10,000, which they indicate is more in <br />line with the event. Staff has reviewed the agreement, received the <br />requisite insurance certificates, considered prior damages at the site <br />relative to this event and operator, and supports the bond reduction <br />request. <br />Short stated his approval of staff recommendation. <br />Gibson expressed concern and said that the financial stability of an <br />insurance carrier should be a factor in future contract considerations. <br />Jacobsen said that the potential lost revenue of a site immediately following <br />an event should also be a consideration in future contract considerations. <br />It was moved by Gibson, seconded by Jacobsen, and carried 5-0 to <br />accept property damage and holdover performance bond with North <br />American Amusements doing business as (DBA) Shamrock Shows for <br />a community carnival at Conejo Creek South Park in the amount of <br />$10,000 (ten thousand dollars.) <br />D.
