May 6, 2010 <br />Page 3 <br />It was moved by Holt, seconded by Jacobsen, and carried 5-0 to adopt <br />Resolution No. 050610-A ordering the levy of assessments for LMD 92-1 <br />(Rancho Conejo); that it be read in title only and all further readings be waived. <br />B. Public Hearing to Consider Adoption of Resolution No. 050610-13, Ordering the <br />Levy of the Annual Assessment for Landscape Maintenance District 94-1 <br />Hare stated that on April 15, 2010 the Board adopted a Resolution of Intention to levy <br />assessments for LMD 94-1 (Dos Vientos) for fiscal year 2010-11, which set the date, <br />time and place for the Public Hearing required for the levy of annual assessments. <br />The resolution under consideration confirms and approves the final Engineer's Report <br />for LMD 94-1 and confirms the levies of $227.82 per single family unit, which are <br />within the allowable range. The Notice of Public Hearing was published in Ventura <br />County Star on April 26, 2010. <br />It was moved by Jacobsen, seconded by Lange, and carried 5-0 to adopt <br />Resolution No. 050610-113, ordering the levy of assessments for LMD 94-1 (Dos <br />Vientos); that it be read in title only and all further readings be waived. <br />C. Library Lease Agreement and Covenants, Conditions and Restrictions (CC&R) <br />Amendments <br />Friedl referenced the documentation and provided relevant information. He said that <br />in 2002 the City of Thousand Oaks (City) financed the expansion of the Grant R. <br />Brimhall Thousand Oaks Library and Goebel Senior Adult Center utilizing Certificates <br />of Participation (COPs) which involve a lease and leaseback arrangement between <br />the City and Thousand Oaks Public Financing Authority. The City is now preparing <br />the necessary documentation to take advantage of lower interest rates. The proposed <br />amendments to the lease and CC&Rs are intended to reflect completion of the library <br />construction and allow the City to prepare necessary financing documentation. <br />Gibson requested additional information on the refinancing terms and conditions. <br />It was moved by Holt, seconded by Short, and carried 5-0 to authorize the <br />General Manager to execute First Amendment to Library Lease Agreement No. <br />594 and First Amended and Restated Declaration of Covenants, Conditions and <br />Restrictions (Lot Tie Agreement). <br />9.
