ITEMS FOR DISCUSSION <br />9. NEW ITEMS <br />A. Conejo Creek West Dog Park Improvement Project — Release <br />Agreement with G2K Construction, Inc.; Award Bid to FS <br />Contractors, Inc. <br />Hare referenced the Supplemental Information provided today which <br />updates the recommendations, authorizing the General Manger to enter <br />into a release agreement in substantial compliance to the referenced <br />document. He reviewed the recommendations and provided some <br />background, including the reason for the necessity of the release -- G2K) s <br />submission of an alternate shade structure which was rejected by staff as it <br />did not meet the specific bid requirements. Mark Sellers, District Counsel, <br />appearing via telephone, reviewed the dispute and how it was handled; <br />including the conclusion that the best approach was to allow G2K to <br />withdraw their bid and have their bid bond returned and to award the project <br />to FS Contractors. FS Contractors was the third lowest bidder; the second <br />lowest, BuiltAll Construction, was non-responsive; therefore, their bid was <br />rejected. <br />It was moved by Huffer, seconded by Cusworth, and carried 5-0 to: <br />
