<br /> <br /> <br /> <br />solely by the District. UEC’s total base bid in figures “$898,000” is consistent with the words <br />provided “Eight Hundred Ninety Eight Thousand Dollars Even”. The breakdown of costs (Part A, <br />B, C, D) are for District accounting purposes only and is not a determining factor of the low bid. <br /> <br />2. Unlimited failed to list a certified playground installer, as required <br /> <br />The bid form, page 28, required that the "Playground installer must have a Certified <br />Playground Safety Inspector (CPS]) Certification ... " See Attachment 3. Unlimited did not <br />list any subcontractors. See Attachment 4. Unlimited is not qualified to self-perform the <br />playground installation because it does not itself hold the CPSI Certification. Unlimited's <br />bid is non-responsive because it failed to list a CPSI-certified subcontractor and failed to <br />provide a showing that Unlimited is itself CPSI certified. The bid should be rejected as such. <br /> <br />Response: Per bidding instructions (Exhibit 2), on BID FORM 6 page 28 “Playground installer <br />must have Certified Playground Safety Inspector (CPSI) Certification…”. There is no bidding <br />requirement to provide proof of CPSI certification. This is a contractual requirement which is <br />confirmed as part of the contract obligation. Additionally, a subcontractor only has to be listed on <br />BID FORM 5 page 21 if the subcontractor “will perform work in an amount in excess of one-half <br />of one percent (1/2%) of the Contractor’s Total Bid Price.” This certification can come from a <br />third party inspecting the installed equipment, not just from the party installing it. That <br />Inspection fee is about $500 per playground, so a very low cost of approximately $1500 for all 3 <br />project sites, an amount less than ½% of the total bid. <br /> <br /> <br />3. Unlimited failed to list five (5) similar projects, as required <br /> <br />The bid form required that bidders list reference projects similar in scope and complexity <br />to this project. The dollar values of Unlimited's reference projects -$470,039.40; <br />$238,821.45; $398,312.00; $130,817.78; $205,704.26 - are not comparable to the scope <br />and complexity of this project. See Attachment 3. Because it failed to list the required <br />similarly-complex projects, Unlimited's bid is non-responsive and should be rejected as <br />such. <br /> <br />Response: Each individual project UEC listed as reference are of similar scope and complexity <br />to the project. <br /> <br />ECI’s reasons for MCI protest are listed below in italics; CRPD responses follow: <br /> <br />1. Micon failed to list its treasurer, as required <br /> <br />The Information Required of Bidders form required that bidders list their treasurer's name. <br />Instead of doing so, Micon responded "NIA." See Attachment 5. Micon's chief financial <br />officer is Mariia Los. See Attachment 6. Ms. Los should have been listed on the form. <br />Micon's bid is non-responsive and should be rejected as such. <br /> <br />Response: MCI’s minor irregularity, if necessary (because the Board accepts ECI’s protest of <br />UEC’s bid), should be waived, as it does not affect the bid and it does not affect their ability to do <br />the work.
