<br /> <br /> <br /> <br /> <br />2. Micon failed to list five (5) similar projects, as required <br /> <br />Micon only listed two (2) projects of similar size to this project. See Attachment 7. One of <br />its reference projects, "Agate Park" for Jurupa Valley Recreation & Park District, was only <br />$316,314 - much smaller than Micon's $1,034,456 bid in this project. Micon also listed two <br />maintenance contracts, for the City of Moreno Valley and the City of Tustin, with a range <br />of contract amounts rather than the single dollar value required by the bid form. <br />Maintenance contracts such as these are not at all similar to the construction contract in <br />this project. Micon's bid is non-responsive and should be rejected as such. <br /> <br />Response: Each individual project MCI listed as reference are of similar scope and complexity <br />to the project. <br /> <br />In consultation with outside counsel (Exhibit 3), staff recommends the Board deny ECI’s protest <br />of UEC and MCI. As the irregularity is minor; UEC did not receive an unfair competitive <br />advantage; the irregularity does not alter the base bid nor otherwise defeat the goals of preventing <br />corruption in the public contracting process; therefore, that bid irregularity can be waived by the <br />CRPD Board. <br /> <br />Thus, staff recommends awarding bid to Unlimited Engineering Contracting Inc. UEC is a <br />qualified Contractor, with an A - General Engineering Contractor and B – General Building <br />Contractor, and has performed projects of similar size and scope with the District.
