Facility Use Consent and Waiver of Liability Agreement between PathPoint and Conejo Recreation and Park District This Facility Use Consent and Waiver of Liability Agreement (Agreement) is between the Conejo Recreation and Park District (CPRD), an independent California special district, and PathPoint, a 501(c)(3) non-profit organization dedicated to helping people with disabilities or disadvantages to reach their fullest potential. The purpose of this Agreement is for PathPoint's client's and staff to have a place to take refuge as a temporary emergency shelter should an unexpected emergency occur and displace them from their own facility at 501 Marin St #112, Thousand Oaks. Based on current enrollment, staff and program participation at PathPoint, the estimated maximum number of persons who may require temporary emergency shelter pursuant to this Agreement is 65. The primary temporary emergency shelter is Hillcrest Center, 403 Hillcrest Drive, Thousand Oaks, CA. The secondary emergency shelter is Thousand Oaks Community Center, 2525 N. Moorpark Rd., Thousand Oaks CA. Should either the primary or secondary emergency shelter facilities be unavailable, then the CRPD General Manager or designee may designate any other suitable CRPD Facility (Facility) as a temporary emergency shelter. The above parties agree to the following terms and conditions. 1. Path Point, its staff and persons served by PathPoint, will use the Facility at their own risk. The term 'use' means the entry into and/or use of Facility. PathPoint acknowledges that CRPD is not obligated to provide any CRPD staffing, monitor or security guard for the Facility. 2. Path Point staff and persons served will use the Facility in a safe and prudent manner and shall not misuse any equipment therein. PathPoint is responsible for supervision of their participants; cleaning -up the facility/surrounding area which they use; putting away tables and chairs that are used; and returning room to the original set up. 3. Waiver, Release, Indemnity. PathPoint understands that in participating in activities at the Facility, or in use of the equipment or the Facility in any way, there is a possibility of accidental or other physical injury, loss of life or loss of personal property. PathPoint hereby releases and forever discharges CRPD, its officers, directors, agents, employees, members, heirs, administrators, successors, and assigns ("Released Parties") from any and all liability, harm and damage, and waives any and all claims whatsoever for any injury, accident, loss of like or loss in connection with our use of or entry into the Facility. In addition, PathPoint agrees to forever defend, indemnify and hold harmless the Released Parties from any and all costs, claims, liability, harm, damage or expenses resulting from PathPoint's use of entry into the Facility or the equipment.
