Facility Use Consent and <br />Waiver of Liability Agreement between <br />PathPoint and <br />Conejo Recreation and Park District <br />This Facility Use Consent and Waiver of Liability Agreement (Agreement) is between the Conejo <br />Recreation and Park District (CPRD), an independent California special district, and PathPoint, a 501(c)(3) <br />non-profit organization dedicated to helping people with disabilities or disadvantages to reach their <br />fullest potential. <br />The purpose of this Agreement is for PathPoint's client's and staff to have a place to take refuge as a <br />temporary emergency shelter should an unexpected emergency occur and displace them from their own <br />facility at 501 Marin St #112, Thousand Oaks. Based on current enrollment, staff and program <br />participation at PathPoint, the estimated maximum number of persons who may require temporary <br />emergency shelter pursuant to this Agreement is 65. <br />The primary temporary emergency shelter is Hillcrest Center, 403 Hillcrest Drive, Thousand Oaks, CA. <br />The secondary emergency shelter is Thousand Oaks Community Center, 2525 N. Moorpark Rd., <br />Thousand Oaks CA. Should either the primary or secondary emergency shelter facilities be unavailable, <br />then the CRPD General Manager or designee may designate any other suitable CRPD Facility (Facility) as <br />a temporary emergency shelter. <br />The above parties agree to the following terms and conditions. <br />1. Path Point, its staff and persons served by PathPoint, will use the Facility at their own risk. The <br />term 'use' means the entry into and/or use of Facility. PathPoint acknowledges that CRPD is not <br />obligated to provide any CRPD staffing, monitor or security guard for the Facility. <br />2. Path Point staff and persons served will use the Facility in a safe and prudent manner and shall <br />not misuse any equipment therein. PathPoint is responsible for supervision of their participants; <br />cleaning -up the facility/surrounding area which they use; putting away tables and chairs that are <br />used; and returning room to the original set up. <br />3. Waiver, Release, Indemnity. PathPoint understands that in participating in activities at the <br />Facility, or in use of the equipment or the Facility in any way, there is a possibility of accidental <br />or other physical injury, loss of life or loss of personal property. PathPoint hereby releases and <br />forever discharges CRPD, its officers, directors, agents, employees, members, heirs, <br />administrators, successors, and assigns ("Released Parties") from any and all liability, harm and <br />damage, and waives any and all claims whatsoever for any injury, accident, loss of like or loss in <br />connection with our use of or entry into the Facility. In addition, PathPoint agrees to forever <br />defend, indemnify and hold harmless the Released Parties from any and all costs, claims, <br />liability, harm, damage or expenses resulting from PathPoint's use of entry into the Facility or <br />the equipment. <br />
