Tek -up Construction's bid contained two minor irregularities: <br />Page two of the bid package submittal requested information such as firm name, <br />address, telephone number, license, etc... was not completed. The basic <br />information was mostly provided in other parts of the submittal and the missing <br />information was requested and completed (attached) after the bid opening. <br />Page four of the bid package submittal requested bidder to restate Total Base <br />Bid from page one of the bid package and bid a lump sum for the Deduct <br />Alternate 1. Tek -up placed the lump sum for Deduct Alternate 1 on the Total <br />Base Bid and placed an irrelevant number on the Deduct Alternate 1 line. See <br />attached email clarification from Tek -up. <br />Staff recommends these irregularities be waived as they are minor and do not affect <br />Tek -up Construction's Total Base Bid or their ability to do the work. <br />Additionally, a bid protest (attached) was received on September 3, 2010 from <br />MACCOR Construction. Under California Public Contract Code, public agencies shall <br />award contracts to the lowest responsible, responsive bidder. Tek -up Construction has <br />submitted the lowest bid; has demonstrated the attribute of trustworthiness, as well as <br />quality, fitness, capacity, and experience to satisfactorily perform the work; and has <br />provided an unconditional offer to provide the goods and services that are being bid <br />upon, and complies (with minor irregularities noted above) with all of the bid procedures <br />that are set forth in the requirements of the bid documents. <br />Staff has checked references and is satisfied that Tek -up is capable of performing the <br />work, including their listed sub -contractors.
