JOINT USE AGREEMENT <br />BETWEEN CONEJO RECREATION AND PARK DISTRICT <br />AND HILLCREST CHRISTIAN SCHOOL <br />(Revised 02102106) <br />This joint use agreement is made effective upon the date of agreement execution and terminates on <br />February 1, 2009. This agreement is by and between the Hillcrest Christian School, hereinafter <br />designated as "SCHOOL," and the Conejo Recreation and Park District, hereinafter designated as <br />"DISTRICT," and shall jointly use the Estella Park property in accordance with the conditions set forth <br />below: <br />1. School will hold the DISTRICT harmless, and indemnify the DISTRICT, its officers, and employees <br />for any and every claim or demand which may be made by any person(s) as a result of the use of the <br />property by the SCHOOL. The DISTRICT will hold SCHOOL harmless for any claims made by <br />any person(s) as a result of the public use of the property. <br />2. The DISTRICT will have use of the property each school day between 3:30 p.m. and 10:00 p.m. and <br />all Saturdays, Sundays, holidays, and other days when the SCHOOL is not in session. The .2 -acre <br />property shall be fenced and gated, gate remaining locked during SCHOOL's hours of operation <br />(7:00 a,m. to 3:30 p.m.). <br />3. School will unlock the gate to the fenced .2 -acre property each school day at 3:30 p.m., and will lock <br />it at 7:00 a.m. The fence at the northern boundary of the property was placed on DISTRICT <br />property, and will become DISTRICT property at the termination of this AGREEMENT. <br />4. During this joint use period, SCHOOL shall name DISTRICT as additional insured on their liability <br />insurance policy. Should SCHOOL wish to extend the term of this Joint Agreement beyond <br />February 1, 2009, that extension shall be subject to agreement by both parties and approval by the <br />DISTRICT Board of Directors. <br />5. School shall remit to the DISTRICT on the first day of each month $275 for maintenance and <br />operations costs. <br />6. Vandalism and damage costs resultant from public use will be borne by the DISTRICT, damages <br />resultant from SCHOOL use will be borne by SCHOOL. <br />7. SCHOOL may terminate this Joint Use Agreement any time within the term by request in writing. <br />DISTRICT agrees to make no effort to terminate this AGREEMENT prior to the one-year term, <br />however, should legal proceedings mandate the return of the improvements to full public use prior to <br />the end of the one-year term, this agreement shall become null and void. <br />Hillcrest Christian School <br />Date By: <br />Date <br />Conejo Recreation and Park District <br />By: <br />
