RESOLUTION 090105-A A RESOLUTION OF THE CONEJO RECREATION AND PARK DISTRICT ADOPTING THE MITIGATED NEGATIVE DECLARATION FOR THE CONEJO CREEK PARK NORTHWEST QUADRANT DOG PARK LIGHTING PROJECT, A MITIGATION MONITORING AND REPORTING PROGRAM, AND FINDINGS OF FACT Whereas, the Conejo Recreation and Park District proposes to add lighting to the dog park to allow park patrons year-round use of the park until 8:30 PM. The proposed Project adds seventeen (17) square steel light poles 30 feet in height mounted on concrete footings. Each arm -mounted with 1 "shoebox" style fixture with cut-off distribution. One 400 -watt metal halide lamp per fixture. The lighting system includes both automatic and manual "push-button" controls which would only be activated as needed and would automatically turn-off at 8:30 PM; and Whereas, the District has prepared a mitigated negative declaration (MND) and the MND was circulated for public review and comment on July 25, 2005 through August 15, 2005 and in accordance with applicable law, including the California Environmental Quality Act, Public Resources Code §21000, et seg., and the State CEQA Guidelines, 14 California Code of Regulations §15000 et sect.; and Whereas, the MND found that potential impacts from the project related to energy resources, noise and traffic were less than significant. With the implementation of mitigation measures, impacts related to aesthetics (addition of lighting) can be reduced to a level less than significant; and Whereas, the Conejo Recreation and Park District is a Lead Agency as defined by CEQA Guidelines, 14 California Code of Regulations §§ 15050 to 15053; and now therefore be it Resolved, that the Board of Directors of the Conejo Recreation and Park District hereby finds that: The presumption of adverse effect set forth in 14 California Code of Regulations §753.5(d) does not apply; Resolved further, that the Board hereby: 1. Adopts that the final MND has been completed in compliance with CEQA; 2. Finds that the Board has reviewed and considered the information in the final MND before approving the project; 3. Finds that the final MND reflects the Conejo Recreation and Park District's independent judgment and analysis;
