Board of Directors - 2, September 1, 2005 On September 9, 2004, after an administrative hearing, the lighting application was denied with the recommendation that the District provide additional traffic and lighting studies in response to concerns raised during the administrative hearing. In response, District staff and consultants have prepared the attached Mitigated Negative Declaration (MND) for the proposed dog park lighting project. On July 25, 2005, the 20 -day review and comment period began for the Draft MND. The notice of public review was also published on this date in the Ventura County Star and all residences within 500 feet of the subject property were notified via postcards by mail. The notice as well as the Draft MND was also sent to the City of Thousand Oaks. Three comment letters were submitted in response to the public notice. Staff and Consultant responses to these comments are included with the proposed Final MND attached. Project Description: The existing dog park of 3.45 acres with perimeter fencing and turf inside the fence boundary and adjacent parking lot comprise the complete lighting project area. The project would add seventeen (17) square steel light poles 30 feet in height mounted on concrete footings. [A typical street light pole in Thousand Oaks is 32 feet on arterials, 31 feet on residential collector street and 25 feet on residential streets.] Each pole is arm -mounted with a "shoebox" style fixture with cut-off distribution. One 400 -watt metal halide lamp per fixture. The lighting system has both automatic and manual "push-button" controls which would only be activated as needed and would automatically turn-off at 8:30 PM. The system is designed for illumination levels of an average of 1 to 2 footcandles on the ground — the City's standard for parking lots. The purpose of the project is to allow park patrons with dogs to be able to use the park after typical work hours until 8:30 PM regardless of the season. The environmental review of the project under CEQA identified potentially significant effects related to aesthetics (addition of lighting), but found that with the implementation of mitigation measures, impacts would be less than significant. Potential impacts related to energy resources, noise, traffic and all other areas were determined to be less than significant impacts. Prior to project approval, the Board of Directors, as Lead Agency for the Project, is required to adopt the final MND, make certain findings as required by law including Findings of Fact, and adopt a Mitigation Monitoring and Reporting Program (all of which are included in the packet). RECOMMENDATION Staff recommends that the Board of Directors adopt the attached Resolution No. 090105-A that: 1. Adopts that the final MIV'D has been completed in compliance with CEQA; 2. Finds that the Board of Directors has reviewed and considered the information in the final MND before approving the project; 3. Finds that the final MND reflects the District's independent judgment and analysis;
