CONEJO RECREATION AND PARK DISTRICT AND SOUTHEAST VENTURA COUNTY YMCA PROPERTY USE AGREEMENT THIS AGREEMENT is made and entered into by and between SOUTHEAST VENTURA COUNTY YMCA, hereinafter called "YMCA", and CONEJO RECREATION AND PARK DISTRICT, hereinafter called "DISTRICT", WHEREAS, the Conejo Recreation and Park District is charged by law with the -responsibility of providing recreation and park services to the fullest extent possible to the residents living within the geographic boundaries of the DISTRICT, and WHEREAS, there is a significant unmet public need for aquatic and hydrotherapy services for the general public within said DISTRICT, and WHEREAS, the Conejo Recreation and Park District is not presently in a financial position to construct facilities for public aquatic and hydrotherapy services at its present facilities. WHEREAS, the Southeast Ventura County YMCA proposes to construct facilities for aquatic and hydrotherapy services at its present facilities, and WHEREAS, the Southeast Ventura County YMCA proposes to construct facilities for aquatic and hydrotherapy services and has offered, for certain fees, to make those facilities available to the Conejo Recreation and Park District for the use of the general public, and WHEREAS, the availability of the proposed YMCA aquatic and hydrotherdpy services to the public through the Conejo Recreation and Park District would fulfill an important public need and serve a worthwhile public purpose, and WHEREAS, the Southeast Ventura County YMCA does not at the present time possess sufficient funds to fully construct the aquatic and hydrotherapy facilities it needs, and WHEREAS, the advancement of certain funds and the payment of certain fees by the Conejo Recreation and Park District, coupled with funds presently raised by the Southeast Ventura County YMCA would create sufficient funding to allow the publicly -needed aquatic and hydrotherapy facilities to be built, NOW, THEREFORE, the Conejo Recreation and Park District, hereinafter "DISTRICT", and the Southeast Ventura County YMCA, hereinafter "YMCA", do covenant and agree as follows:
