Minutes 7-25.-96 <br />Page 3 <br />the proposed MOU, noting that: the MOU has preliminarily <br />been approved by the homeowners' association, all capital <br />and maintenance costs plus liability costs would be <br />assumed by the homeowners' association for a period of <br />five years, savings to the District would be <br />approximately $4,000 per year, and staff is monitoring <br />the landscape plans carefully. <br />Lange suggested that: the agreement evaluation be <br />conducted prior to the conclusion of the MOU; precautions <br />be taken to protect the District against costs of <br />unfinished capital projects should the agreement be <br />abruptly terminated; and the MOU language be changed, <br />such that the parcel of land is not incorrectly <br />identified as Hidden Canyon Park. <br />It was moved by Berger, seconded by Lange, and carried <br />unanimously, 5-0, to approve the Memorandum of <br />Understanding between the Hidden Canyon Homeowners <br />Association and the Conejo Recreation and Park District <br />with respect to capital improvements and maintenance <br />responsibilities, with the following modifications: <br />agreement evaluation to be conducted prior to the <br />conclusion of the MOU; precautions to be taken to protect <br />the District against costs of unfinished capital projects <br />should the agreement be abruptly terminated; and the <br />parcel of land not to be incorrectly identified as Hidden <br />Canyon Park. <br />9.
