It was agreed that Section 414 be modified slightly to limit the General <br />Manager's role to the administrative hearing process. <br />Section 414 modification to read: In the interest of public health, safety, and <br />welfare, it may be necessary to exclude persons or groups from District areas <br />and/or facilities. Such action may be taken by a designated representative of <br />the General Manager, subject to appeal to an Administrative Hearing with the <br />General Manager. <br />In response to Board inquiries, staff said that the problems at EI Parque de la <br />Paz have diminished since alcohol possession has been prohibited. Relative to <br />Estella Park, staff explained that appropriate signage will be posted on August <br />8, the site has been modified slightly to make the facility more visible from the <br />street, and staff does not believe that other facilities need to be redesigned at <br />this time. <br />It was moved by Gibson, seconded by Berger, and carried 5-0 to adopt <br />Resolution Number 080703-B modifying Sections 414 as amended, and <br />106, and 415, as submitted, of the District's Ordinance Manual; that it be <br />read in title only and all other readings be waived. <br />B. Approval Of Addendum To Agreement With Conejo Unified School District <br />Relative To Conejo Elementary School <br />Referencing a map, Marchesano identified the Conejo Elementary School site, <br />designated areas A through D, and surrounding locale, and provided <br />background information. He said that the 20 -year old agreement originally <br />specified that the school would provide for the District's use of areas A, B, C, <br />and D (Conejo Service Yard), and the District would improve and maintain <br />certain Conejo Elementary School facilities. He noted that the proposed <br />modifications include omitting Area A from the lease, limiting the lease terms for <br />Areas B and C to five-year periods, limiting the lease term for Area D to a two- <br />year period, with a clause stating the area may be renegotiated on a year-to- <br />year basis. He said that staff has relocated much of the equipment from Conejo <br />Service Yard to various locations including Oakbrook Service Yard, and it is <br />anticipated that in the future it will become the main service yard in this area. <br />In response to Jacobson's concern about meeting the recreational needs of the <br />people in the area of Beyer Park, Sorensen said that the area is becoming more <br />impacted, and a zoning analysis will be conducted during the coming year, and <br />the results of that analysis will be provided to the Board. <br />
