August 7, 2003 <br />Page 2 <br />Lange declared the Public Hearing open. <br />Ward said that the budget is balanced, and, based on Board input, some <br />adjustments were made. <br />Gibson said he appreciated the changes, and was satisfied with the budget. <br />Holt noted that the budget has been reviewed and discussed in detail during <br />many previous Board sessions. <br />In response to Jacobsen's inquiries, Sorensen said that in the past the principal <br />ADA (Americans with Disabilities Act) mandates have been to playground <br />projects, and the District has completed ail ADA retrofit mandates, although new <br />playgrounds will be constructed to current ADA standards. <br />Ward thanked staff members for their efforts on the budget. <br />Lange closed the Public Hearing. <br />It was moved by Gibson, seconded by Jacobson, and carried 5-0 to adopt <br />Resolution Number 080703-A, adopting the Fiscal Year 20032004 Budget <br />for the District; that it be read in title only and all other readings be <br />waived. <br />8. NEW ITEMS <br />A. Adoption Of Resolution Number 080703-B Modifying Section Of District <br />Ordinance Manual <br />Marchesano provided background information. He stated that, as written, <br />Section 414 (Exclusion from District Areas and Facilities) of the District's <br />Ordinance Manual is difficult to enforce, and based on research and a meeting <br />with representatives of City of Thousand Oaks Police Department and the <br />Ventura County District Attorney's Office, staff recommends the proposed <br />changes and additions identified in the documentation. Additionally, he said <br />that based on concerns from residents and the Thousand Oaks Police <br />Department, staff believes it is in the community's best interest to modify <br />Section 415 to include Estella Neighborhood Park in the list of parks and <br />facilities from which alcohol is excluded. <br />Gibson expressed concern that, as proposed, Section 414 would allow the <br />General Manager to be involved at both the point of action and the appeal <br />
