May 1, 2003 <br />Page 7 <br />It was moved by Berger, seconded by .Jacobsen, and carried 5-0 to <br />adopt Resolution Number 050103-F declaring its intention to provide <br />for an annual levy and collection of assessments in Landscape <br />Maintenance District No. 94-1 (Dos Vientos Ranch) and setting a time <br />and place for Public Hearing thereon; that it be read in title only and all <br />other readings be waived. <br />B. Authorization To Approve Construction Drawings For Purpose Of <br />Securing Design Immunity <br />Sorensen referenced California Government Code 830-831.9 under which <br />neither a public entity nor a public employee is liable for an injury caused by <br />a plan or design where such a plan or design has been approved in <br />advance of construction by the legislative body or employee exercising <br />discretionary authority to give such approval, and said that the District's <br />design immunity defense would be buttressed if formai action is taken by <br />the Board to confer discretionary approval of plans to professional staff. <br />In response to Jacobsen's inquiry, Sorensen said this action would only be <br />applicable to plans for future construction projects. <br />It was moved by Holt, seconded by Berger, and carried 5-0 to confer <br />upon staff discretionary authority to approve construction drawings <br />for the purpose of securing design immunity within the context of <br />California Government Code 830.6. <br />9. ITEMS FOR DISCUSSION <br />B. Intergovernmental Subcommittee Meeting <br />Ward summarized the April 17 meeting of the Intergovernmental Sub <br />Committee meeting, relative to the use of City of Thousand Oaks developer <br />fees. He identified the representatives and said that CVUSD (Conejo <br />Valley Unified School District) representatives presented cost estimates and <br />funding scenarios to accomplish stadium improvements at the three high <br />schools, and, given the request by the Council representatives that CRPD <br />propose priority projects for consideration, it was felt that the Board as a <br />whole should have the opportunity to discuss priorities based upon the <br />assumption that some funding may be available. He said that a <br />fundamental difficulty is the lack of criteria upon which consideration for <br />funding will be based. He referenced a draft list of potential projects. <br />
