If the drug screen is positive, the employee must provide within 24 hours of request bona <br />fide verification of a valid current prescription for the drug identified in the drug screen. <br />The prescription must be in the employee's name. If the employee does not provide <br />acceptable verification of a valid prescription, or if the prescription is not in the employee's <br />name, or if the employee has not previously notified his or her supervisor, the employee <br />will be subject to disciplinary action up to and including termination. <br />If an alcohol or drug test is positive for alcohol or drugs, the District shall conduct an <br />investigation to gather all facts. The decision to discipline or terminate will be carried out <br />in conformance with Chapters 24-26 of the District's Personnel Policy Manual. <br />The Alcohol/Drug Abuse Report shall not be considered valid until signed by a trained <br />supervisor/manager and the General Manager or his designee. Any such report shall be <br />removed from the file unless confirmation is made the violation took place. <br />CONFIDENTIALITY <br />Suspicion of, discipline for, participation in EAP laboratory reports and test results shall not <br />appear in an employee's general personnel folder. Information of this nature will be <br />contained in a separate confidential medical folder that will be securely kept under the <br />control of the Human Resources office. The reports or test results may be disclosed to <br />District management on a strictly need -to -know basis and to the tested employee upon <br />request. Disclosures, without patient consent, may also occur when: (1) the information is <br />compelled by law or by judicial or administrative process; (2) the information has been <br />placed at issue in a formai dispute between the employee and employee; (3) the <br />information is needed by medical personnel for the diagnosis or treatment of the patient <br />who is unable to authorize disclosure. <br />Disclosure of any information garnered through the administration of this policy is a <br />violation of this policy and may cause discipline up to and including termination of the <br />person or persons making the disclosure. <br />ARTICLE 44 INDUSTRIAL INJURY AUGMENTATION <br />Upon full return to duty, employees who have been on industrial leave and whose vacation <br />and sick leave accruals have fallen below 40 hours each will be advanced sufficient hours <br />to establish accruals of 40 hours sick leave and 40 hours vacation. Employees will <br />receive no additional accruals to these hours until their normal accruals have reached 40 <br />hours vacation and 40 hours sick leave. <br />ARTICLE 45 EMPLOYEE WELLNESS PROGRAM <br />The District will reimburse up to $15 per month for wellnesslfitness related expense such <br />as non-traditional medical treatment, health club memberships, weight loss programs, <br />smoking cessation programs, etc. <br />30 <br />
