Conejo Recreation and Park District Responsibilities. <br />• Assist in developing Fire Department Safety/floor plan and schedule. <br />• Assist volunteer recruitment as requested. <br />• Assist in community -wide publicity. <br />• Assist to obtain any required permits from the City and/or Fire Department or other public agencies. <br />• Coordinate with Janss Marketplace any auxiliary activities (i.e., Young Artists Ensemble/Teen <br />Center display, as deemed mutually appropriate). <br />• Provide a certificate of additional insurance naming Landlord and NewMark Merrill Companies <br />for the period of approximately April 1, 2023, through December 31, 2023, as it relates to this <br />activity and during any period when Tenant is in possession of the Premises during any furnishing <br />or fixturing period. <br />Janss Marketplace Responsibilities. <br />• Provide a space from approximately April 1, 2023, through December 31, 2023. <br />• Provide and implement approved marketing -plan. <br />• Implement security plan during the run of the tours. <br />Bruce Stanton Responsibilities. <br />• Jointly develop Fire Department Safety/floor plan and schedule. <br />• Purchase supplies. <br />• Build and install components for the Haunted House and construct an interior/exterior "ticket <br />booth." <br />• Provide and train volunteers for the operation of the Haunted House. <br />• Operate the Haunted House as scheduled in the Use section of this Agreement. <br />• Coordinate "move -in," strike, and storage of Haunted House materials. <br />• Sell tickets and lead in management of the facility/pro gram. <br />• Provide to Landlord the Security Deposit and set up the Utilities as provided in this Agreement. <br />• Donate the portion of the net revenues as determined among the Tenant I enant entities to the Young Artists <br />Ensemble and the Thousand Oaks Teen Center. <br />Tenant Improvements. Landlord and Tenant agree that Tenant accepts the Premises in its "as -is" <br />condition and Landlord shall not be required to make any renovations to improvements to the Premises, <br />except as expressly provided herein, including, but not limited to, any city or other governmental <br />requirements. Tenant agrees to remove from the Premises all displays and Tenant's other property on or <br />before the end of the term, leaving the Premises clean and free of debris and shall restore and return the <br />Premises to the same condition that it was delivered. Tenant agrees to at all times keep the area clean and <br />free of debris and trash. <br />Alteration, Additions, Improvements and Repairs. <br />(a) Tenant shall not make any alterations, additions or improvements to the Premises other <br />than those associated with a haunted house on the Premises. <br />(b) Landlord shall make all repairs to the Premises required in order for Tenant to use the <br />Premises for its intended purposes within a reasonable time after receipt of written notice of the need <br />therefor; provided, however, that Landlord may terminate this Agreement upon thirty (3 0) days' prior <br />written notice to Tenant in lieu of making any such repairs; and if Tenant cannot reasonably use the <br />Premises for its intended purposes as a result of such repairs not being made, Tenant may terminate this <br />Agreement upon written notice to Landlord and Tenant vacating the Premises.
