Since the March 18, 2021 award, staff and representatives from G2K have made efforts to execute the
<br />contract and coordinate the start of the work. During these initial efforts, District staff was presented
<br />alternate shade structures by G2K; staff rejected the submittal as it did not meet the specific bidding
<br />requirements. As the District and G2K could not agree on how to move forward with the project, it was
<br />mutually agreed to enter into a release agreement. The final release agreement was not available at the
<br />time of preparation of this item; the final release agreement will be provided as a supplemental to this item
<br />as soon it is available prior to the April 15, 2021 meeting.
<br />Bids received and opened at 8:30am on Wednesday, March 3rd:
<br />Upon review and consideration of the apparent #2 low bidder, Builtall Construction (BAC), staff
<br />recommends their March 3, 2021 bid be found non-responsive as Addendums 1 and 2 were not
<br />acknowledged per bidding instructions (and as acknowledged by BAC Attachment 1). These addendums
<br />included material and design changes that would affect BAC's price and thus BAC would receive an unfair
<br />competitive advantage if their bid was accepted.
<br />Upon review and consideration of the apparent #3 low bidder, FS Contractors, Inc. (FSC), staff found the
<br />base bid received meets all the required specifications, including the specified shade structures. FSC has
<br />provided written verification that the bid submitted March 3, 2021 is still valid (Attachment 2).
<br />Consistent with its March 18, 2021 recommendation, staff recommends providing a project with (A) Shade
<br />Structures, (B) Parking Lot and Landscaping, and (C) Restroom and Utility Connections but not (D) Bid
<br />Alternate 1: Shade Structures at Walnut Grove and Kimber Parks.
