Deny Environmental Construction Inc.’s protest of Unlimited Engineering Contracting Inc. and <br />Micon Construction, Inc. bid submittals. <br /> <br />2. Determine that the Dos Vientos Neighborhood Park, Kimber Park, and Rancho Conejo <br />Playfield playgrounds and the North Ranch Neighborhood Park walking path are categorically <br />exempt from the California Environmental Quality Act (CEQA). <br /> <br />3. Award bid to Unlimited Engineering Contracting Inc. for $898,000 Base Bid plus Add Alternate <br />#1 Colored Asphalt Walkway for $35,000, plus contingency in the amount of $102,000, totaling <br />$1,035,000 for construction of playgrounds and walking path. <br /> <br />CEQA COMPLIANCE <br /> <br />For the Board consideration and approval, District staff believes the Dos Vientos Neighborhood <br />Park, Kimber Park, and Rancho Conejo Playfield playground projects qualify for a Class 2 <br />Categorical Exemption, pursuant to Section 15302 of the CEQA Guidelines. Class 2 exemptions <br />include replacement of existing structures and facilities where the new structure will be located on <br />the same site as the structure replaced. In the playground projects, the existing play equipment <br />are being replaced in the same location. <br /> <br />For the Board consideration and approval, District staff believes the North Ranch Neighborhood <br />Park walking path qualifies for a Class 1 Categorical Exemption, pursuant to Section 15301 of the <br />CEQA Guidelines. Class 1 exemptions include operation, repair, maintenance, permitting, <br />leasing, licensing, or minor alteration of existing public or private structures, facilities, mechanical <br />equipment, or topographical features, involving negligible or no expansion of use beyond that <br />existing. In this project, the improvement will transform approximately 11,000 square feet (about
