RESOLUTION NO. 041819-B RESOLUTION OF THE BOARD OF DIRECTORS OF THE CONEJO RECREATION AND PARK DISTRICT PRELIMINARILY APPROVING THE ASSESSMENT ENGINEER'S REPORT FOR FISCAL YEAR 2019/2020, DECLARING ITS INTENTION TO PROVIDE FOR AN ANNUAL LEVY AND COLLECTION OF ASSESSMENTS AND SETTING A TIME AND PLACE FOR PUBLIC HEARING THEREON FOR LANDSCAPE MAINTENANCE DISTRICT NO. 92-1 (RANCHO CONEJO PLAYFIELD) WHEREAS, the BOARD OF DIRECTORS of the CONEJO RECREATION AND PARK DISTRICT, CALIFORNIA, has previously formed a special maintenance district pursuant to the terms of the "Landscaping and Lighting Act of 1972", being Division 15, Part 2 of the Streets and Highways Code of the State of California (the "1972 Act"), said special maintenance district known and designated as Landscape Maintenance District No. 92-1 (Rancho Conejo Playfield) (the "Maintenance District"); and, WHEREAS, the BOARD OF DIRECTORS of the CONEJO RECREATION AND PARK DISTRICT, CALIFORNIA, pursuant to the terms of the "Landscaping and Lighting Act of 1972", being Division 15, Part 2 of the Streets and Highways Code of the State of California (the "1972 Act"), Article XIIID of the Constitution of the State of California ("Article XIIID") and the Proposition 218 Omnibus Implementation Act (Government Code Section 53750 and following) (the "Implementation Act") (the 1972 Act, Article XIIID and the Implementation Act are referred to collectively as the "Assessment Law") desires to take proceedings to provide for the annual levy of assessments for the next ensuing fiscal year to provide for the annual costs for maintenance of improvements within the Maintenance District. WHEREAS, there has now been presented to this Board of Directors the Assessment Engineer's Report as required by the Assessment; and, WHEREAS, the proposed annual assessments for Fiscal Year 2019/2020 as set forth in the Assessment Engineer's Report do not exceed the maximum annual assessments. NOW, THEREFORE, IT IS HEREBY RESOLVED AS FOLLOWS: RECITALS SECTION 1. The above recitals are true and correct. SECTION 2. The public interest and convenience requires, and it is the intention of this legislative body to take proceedings for the annual levy and collection of special assessments for the financing of the costs of the maintenance and/or servicing to be provided during Fiscal Year 2019/2020 of the improvements for the Maintenance District which have been completed and accepted for maintenance by the Board of Directors or are projected to be completed and accepted for maintenance by the Board of Directors during Fiscal Year 2019/2020.
