RESOLUTION NO. 041819-B <br />RESOLUTION OF THE BOARD OF DIRECTORS <br />OF THE CONEJO RECREATION AND PARK DISTRICT <br />PRELIMINARILY APPROVING THE ASSESSMENT ENGINEER'S REPORT FOR <br />FISCAL YEAR 2019/2020, DECLARING ITS INTENTION TO PROVIDE FOR AN <br />ANNUAL LEVY AND COLLECTION OF ASSESSMENTS AND SETTING A TIME <br />AND PLACE FOR PUBLIC HEARING THEREON FOR <br />LANDSCAPE MAINTENANCE DISTRICT NO. 92-1 <br />(RANCHO CONEJO PLAYFIELD) <br />WHEREAS, the BOARD OF DIRECTORS of the CONEJO RECREATION AND PARK <br />DISTRICT, CALIFORNIA, has previously formed a special maintenance district pursuant <br />to the terms of the "Landscaping and Lighting Act of 1972", being Division 15, Part 2 of <br />the Streets and Highways Code of the State of California (the "1972 Act"), said special <br />maintenance district known and designated as Landscape Maintenance District No. 92-1 <br />(Rancho Conejo Playfield) (the "Maintenance District"); and, <br />WHEREAS, the BOARD OF DIRECTORS of the CONEJO RECREATION AND PARK <br />DISTRICT, CALIFORNIA, pursuant to the terms of the "Landscaping and Lighting Act of <br />1972", being Division 15, Part 2 of the Streets and Highways Code of the State of <br />California (the "1972 Act"), Article XIIID of the Constitution of the State of California <br />("Article XIIID") and the Proposition 218 Omnibus Implementation Act (Government Code <br />Section 53750 and following) (the "Implementation Act") (the 1972 Act, Article XIIID and <br />the Implementation Act are referred to collectively as the "Assessment Law") desires to <br />take proceedings to provide for the annual levy of assessments for the next ensuing fiscal <br />year to provide for the annual costs for maintenance of improvements within the <br />Maintenance District. <br />WHEREAS, there has now been presented to this Board of Directors the Assessment <br />Engineer's Report as required by the Assessment; and, <br />WHEREAS, the proposed annual assessments for Fiscal Year 2019/2020 as set forth in <br />the Assessment Engineer's Report do not exceed the maximum annual assessments. <br />NOW, THEREFORE, IT IS HEREBY RESOLVED AS FOLLOWS: <br />RECITALS <br />SECTION 1. The above recitals are true and correct. <br />SECTION 2. The public interest and convenience requires, and it is the intention of this <br />legislative body to take proceedings for the annual levy and collection of special <br />assessments for the financing of the costs of the maintenance and/or servicing to be <br />provided during Fiscal Year 2019/2020 of the improvements for the Maintenance District <br />which have been completed and accepted for maintenance by the Board of Directors or <br />are projected to be completed and accepted for maintenance by the Board of Directors <br />during Fiscal Year 2019/2020.
