Resolution 032119-B Page 2 <br />WHEREAS, all comments were carefully analyzed and responses were prepared in the <br />Responses to Comments section of the Initial Study/Mitigated Negative Declaration; <br />WHEREAS, the Board of Directors was presented with the attached Conejo Creek <br />Southwest Park Initial Study/Mitigated Negative Declaration, including the comment <br />letters and the CRPD's responses thereto (collectively the "IS/MND"), a Project Mitigation <br />Monitoring and Reporting Program, and the March 21, 2019 staff report and attachments <br />thereto; and <br />WHEREAS, on March 21, 2019, the Board held an open public hearing on and for <br />considering its approval of the Conejo Creek Southwest Park Project. <br />NOW THEREFORE, the Board of Directors of the Conejo Recreation and Park District <br />makes the following declarations and findings: <br />In accordance with CEQA Guidelines Sections 15074(a), the Board finds CRPD <br />staff considered the IS/MND and the Project Mitigation Monitoring and Reporting <br />Program prior to making a recommendation to the CRPD Board of Directors to <br />approve the Project and adopt the IS/MND and the Project Mitigation Monitoring <br />and Reporting Program; <br />2. In accordance with CEQA Guidelines Sections 15074(b), the CRPD Board of <br />Directors has considered the IS/MND together with comments received during the <br />public comment period and at the public hearing on this Project prior to taking any <br />action on the Project. The CRPD Board finds on the basis of the whole record <br />before it (including the IS/MND and any comments received) that there is no <br />substantial evidence that the Project, following the incorporation of mitigation <br />measures, will have a significant effect on the environment, and that the IS/MND <br />reflects CRPD's independent judgment and analysis; <br />3. A Mitigation Monitoring and Reporting Program has been prepared for the Project <br />("MMRP"), which serves as the program for reporting on and monitoring the Project <br />construction and operation, including any changes which have either been <br />required to the Project or made as a condition of its approval, is to be enforced and <br />used in order to mitigate or avoid significant environmental effects; that MMRP is <br />attached to the staff report prepared for the approval of the Project and is <br />incorporated by reference into this Resolution adopted by the CRPD Board of <br />Directors. <br />4. The Board finds that the MND for the Project has been completed in compliance <br />with CEQA and the CEQA Guidelines. <br />NOW THEREFORE, the Board of Directors of the Conejo Recreation and Park District <br />resolves as follows: <br />In accordance with CEQA Guidelines Sections 15074(b) and 15074(d), the CRPD <br />Board of Directors adopts the IS/MND and the Project Mitigation Monitoring and <br />Reporting Program ("MMRP") for the Project, and, <br />
