The low bid received from Access Pacific Inc. (API) meets all the required specifications but <br />contains a minor irregularity. <br />Within two business days of the bid opening, as required by the Bid Protest Procedures, staff <br />received a protest from Granite Construction Company (GCC) (Attachment 2) regarding API's bid <br />(Attachment 3). One day later after the deadline for submittal under Bid Protest Procedures, <br />Saifco Construction filed a bid protest (Attachment 4) regarding API's bid and GCC's bid. In <br />consultation with outside counsel (Attachment 5), staff recommends the Board waive the minor <br />irregularity in API's bid submittal as the irregularity is an inconsequential deviation; API did not <br />receive an unfair competitive advantage; the irregularity does not alter the base bid nor otherwise <br />defeat the goals of preventing corruption in the public contracting process; therefore, that bid <br />irregularity can be waived by the CRPD Board. <br />Thus, staff recommends awarding bid to Access Pacific Inc. API is a qualified Contractor, with an <br />A - General Engineering Contractor and B — General Building Contractor, and has performed <br />projects of similar size and scope. All documents are complete (with the waived minor irregularity) <br />and references are excellent. They have completed work for Housing Authority and Department <br />of Public Works, Los Angeles County, and Mountain Recreation Conservation Authority. Both <br />agencies found them to be reliable, highly competent and responsive.
