Holt, Director <br />Joe Gibson, Director <br />Ed Jones, Director <br />GENERAL MANAGER EMERITUS <br />Tex Ward <br />June 2, 2016 <br />Board of Directors <br />Jim Friedl, General <br />Option and Leasegree t for Proposed Verizon Wireless <br />Communications Facility at Uonejo Creek Southwest <br />RECOMMENDATION <br />Authorize the General Manager to execute an option and lease agreement between Verizon <br />Wireless and the District for the purpose of establishing a wireless facility at Conejo Creek <br />Southwest <br />DISCUSSION <br />In February 2005, Conejo Recreation & Park District entered into an option and lease agreement <br />with New Cingular Wireless for a wireless facility at Conejo Creek Southwest. Although approved, <br />New Cingular did not proceed with the project and the agreement expired in 2008. <br />Several providers have since approached the District proposing wireless facilities at this location. <br />With each proposal, a Southern California Edison (SCE) power pole on the property was selected <br />for mounting the antennas. The 101 -foot pole offers the carrier the ability to attach antennas at a <br />height of 70 -feet. Dissuaded, however, by the prospect of having to pay two rents, one to the <br />District and one to SCE, the carriers were unable to secure a workable agreement. <br />Verizon Wireless is the most recent carrier showing interest in the site. Confronted with the same <br />dilemma of a two -rent scenario for the provider, staff negotiated a proposal that would include a <br />capital contribution in exchange for monthly rent abatement for the first five years. The capital <br />contribution is $90,000 with rent commencing on year six at $1,738.91 (rent abatement would not <br />preclude yearly rent escalator of 3%, starting rent at year one of $1,500). <br />The agreement has an initial term of five (5) years and will automatically renew, at the tenant's <br />option, for four (4) additional five-year terms. The lease agreement, rent table, and map exhibit <br />are provided for Board review.
