Lange, Chair <br />Doug Nickles, Vice -Chair <br />Chuck Huffer, Director <br />Nellie Cusworth, Director <br />Marissa Buss, Director <br />GENERAL MANAGER EMERITUS <br />TO: Board of Directors Tex Ward <br />FROM: Jim Friedl, General Manag <br />SUBJECT: Amendment of Existing ption and Site Lease Agreement with New Cingular <br />Wireless (AT&T) for Upgrades to E�,Jstin®� Wireless Communications Facility <br />at Dos Vientos Community Park <br />RECOMMENDATION <br />Authorize the General Manager to approve the second amendment of existing Option and Site <br />Lease Agreements with New Lingular Wireless (AT&T) for equipment upgrades at Dos Vientos <br />Community Park. <br />DISCUSSION <br />Smartlink Group, working on behalf of New Cingular Wireless, is proposing the modification of <br />equipment for an existing wireless facility at Dos Vientos Community Park. <br />The proposed amendment to the lease represents the Second Amendment to the Option and <br />Lease Agreement approved by the CRPD Board of Directors in February 2005. The original <br />Amendments, irrespective of when approved, run concurrently with the original lease when the <br />Option was exercised. <br />The current proposal includes upgrades on the antenna pole and within the vault. Modification of <br />the facility includes adding another antenna array below the existing antenna arrays — see <br />Attachment 1. To compensate for the visual impact on the pole, the District will receive an <br />additional $500 per month, bringing the total current rent, once construction begins, to $4,334.83. <br />The Second Amendment to Option and Lease Agreement (Attachment 2) serves as the applicable <br />document to effectuate this change and accompanies this report for Board review. <br />The approved lease agreement stipulates that the equipment must comply with all environmental <br />and industrial hygiene laws.
