Holt, Director <br />Chuck Huffer, Director <br />DATE: June 3, 2021 <br />TO: Board of Directors <br />GENERAL MANAGER EMERITUS <br />Tex Ward <br />FROM: Jim Friedl, General Mana er ; <br />SUBJECT: Public Utility Easement Deed to Southern California Edison Company for the Installation <br />and Maintenance of an Electrical Power Line at Sapwi Trails Community Park <br />RECOMMENDATION <br />Authorize General Manager to grant a public utility easement in substantial compliance with the attached Public <br />Utility Easement Deed to Southern California Edison Company for an electrical power line at Sapwi Trails <br />Community Park. <br />DISCUSSION <br />In February of 2016, the Board approved an easement to Verizon Wireless (VZW) for access across District <br />property to a telecommunications facility located on Southern California Edison (SCE) property south of Sapwi <br />Trails Community Park. In exchange for the easement, the District received a one-time payment of $500 and <br />an annual income/rent of $9,600 in the first year with a 3% annual increase thereafter. <br />Although permission was granted by the District for Southern California Edison to utilize the easement extended <br />to VZW to install the power Fine necessary to operate the facility, SCE, per company policy, would not accept a <br />third -party agreement. As a result, VZW has been unable to secure this critical connection. A non-exclusive <br />easement, at no cost, between the District and SCE will ensure that VZW will not abandon the site and sever <br />their agreement with the District. <br />The proposed 6 -foot -wide easement will follow the path of VZW's easement from the Erbes Road Pump Station <br />along the road to the southern boundary of Sapwi Trails Community Park.
