Due to this combination of decreased revenues and increased costs, the Park District is <br />proposing the establishment of an assessment district to provide adequate revenues for <br />park maintenance services as well as for expanding and improving park facilities to meet <br />the growing demand placed on the parks. <br />This Engineer's Report ("Report') was prepared to establish the budget for the services <br />that would be funded by the proposed 2001-02 assessments, determine the benefits <br />received from the park maintenance and improvements by property within the Park District <br />and the method of assessment apportionment to lots and parcels within the Park District. <br />This Report and the proposed assessments have been made pursuant to the Landscaping <br />and Lighting Act of 1972, Part 2 of Division 15 of the California Streets and Highways Code <br />(the "Act') and Article XIIID of the California Constitution (the Article"). For a more <br />complete description of the Act and the Article, please refer to Appendix A and Appendix B. <br />Following submittal of this Report to the Conejo Recreation and Park District Board of <br />Directors (the Board") for preliminary approval, the Board may, by Resolution, call for an <br />assessment ballot proceeding, and Public Hearing on the proposed establishment of the <br />assessments for park maintenance and recreational facility improvements. <br />If the Board approves such Resolution, a notice of assessment and assessment ballot <br />would be mailed to property owners within the Park District. Such notice would include a <br />description of the proposed assessments as well as an explanation of the method of voting <br />on the assessments. Each notice would also include a detachable postage prepaid ballot <br />on which the property owner could mark his or her approval or disapproval of the proposed <br />assessments. <br />After the ballots are mailed to property owners in the ParK uâ–şstrict, a minimum 45 -day time <br />period must be provided for the return of the assessment ballots. Following this 45 day <br />time period, a public hearing must be held for the purpose of allowing public testimony <br />regarding the proposed assessments. This hearing is currently scheduled for Tuesday, <br />April 19, 2001 at 7:30 p.m. At this hearing, the public would have the opportunity to speak <br />on this issue and returned ballots would be tabulated. <br />If it is determined at the public hearing that the assessment ballots submitted in opposition <br />to the proposed assessments do not exceed the assessment ballots submitted in favor of <br />the assessments (weighted by the proportional financial obligation of the property for which <br />ballots are submitted) the Board may take action to approve the levy of the assessments <br />for fiscal year 2001-02.
