specified in the attached job classification (Attachment 1); (c) <br />Administer and enforce the policies as may be adopted by the Board; <br />and, (d) Perform such other legally permissible duties and functions <br />as the Board may assign from time to time. The General Manager <br />agrees that, to the best of his ability and experience, he will at all <br />times under the term of this Agreement, loyally remain in the employ <br />of the District and perform all of his assigned duties and obligations <br />set forth in, and that are implicit under, this Agreement. <br />Section 2: "At -Will" Employee Status <br />The General Manager serves as an "at will)) employee (as <br />defined in the California Labor Code Section 2922), serving at the <br />pleasure of the Board, and nothing in this Agreement shall require <br />cause for removal, or prevent, limit, or otherwise interfere with the <br />right of the Board to terminate the services of the General Manager at <br />any time, subject only to the provisions set forth in Sections 3(A), (B) <br />and (C) of this Agreement. 1!,-:` addition, nothing in this Agreement <br />shall prevent, limit, or otherwise interfere with the right of the General <br />Manager to resign at any time from his position with District, subject <br />only to the prop Psion set forth in Section 3 of this Agreement. As the <br />a <br />General Manager serves cat the will of the Board, there is no term to <br />this Agreement and it shall remain in force and effect until terminated <br />as provided in Section 3 �elow. <br />Section 3: Termination and Severance Pay <br />A. Right to Terminate - Employmenf. <br />The Board may <br />terminate the services of the General Manager at any time with a <br />written notice to the General Manager setting forth the date of <br />ri <br />termination in that notice. <br />B. For Cause. In the event the General Manager is <br />terminated for any of the following causes, the District shall have no <br />obligation to pay Severance Pay to the General Manager as provided <br />subsection C below: <br />a. Insubordination, dishonesty, misappropriation of public <br />funds, or falsifying District records; <br />b.
