Holt, Director <br />Chuck Huffer, Director <br />Nellie Cusworth, Director <br />GENERAL MANAGER EMERITUS <br />Tex Ward <br />TO: Board of Directors --` <br />FROM: Sheryl Lewanda, Management Services Administrator <br />SUBJECT: Proposed Restated and Amended Employmen reement with the District's <br />General Manager <br />RECOMMENDATION <br />Adopt the attached updated "Amendment to and fully restated Employment Agreement between <br />Conejo Recreation and Park District and General Manager" and authorize the Chair to sign such <br />on behalf of the District. <br />DISCUSSION <br />The existing contract with the General Manager (GM) includes the following language.- Ian ua e: "The <br />General Manager is entitled to all benefits (including but not limited to health and dental insurance <br />plans, PERS retirement plan, holidays and leave accruals, option to participate in flexible health <br />and dependent care spending accounts) available to Administrator employees as the Board may <br />77 <br />amend from time to time . This text is intended to include the retiree medical benefit for the GM <br />at the same level as that provided to the Administrators. <br />Effective with new hires on or after July 1, 2009, the District discontinued the retiree medical <br />benefit. With the imminent retirement of the Management Services Administratorible who is eligible <br />g <br />for the benefit), the prior replacement of the Recreation and Community Services Administrator <br />(who is not eligible for the benefit), and the anticipated eventual retirement of the Parks and <br />Planning Administrator (who is eligible for the benefit), it is foreseeable that the <br />"benefits... available to the Administrators" will not include the retiree medical benefit, and thus it <br />could be argued, the benefit would unintentionally no longer be available to the GM. <br />The attached Amended and Fully Restated Employment Agreement includes language clarifying <br />Y g <br />the availability of the retiree medical benefit to the GM, regardless of the retiree medica0 benefit <br />status of the Administrators at the time the GM retires. <br />In addition, rather than adding another amendment to the existing agreement, we asked Mark <br />Sellers, of Jackson Tid us Law Corporation to update the agreement to reflect its amendments <br />and recommend other non -benefit changes for consideration. <br />ADMINISTRATIVE OFFICES <br />403 West Hillcrest Drive I Thousand Oaks, CA 91360-4223 <br />(805) 495-6471 1 FAX: (805) 497-3199 1 Email: parks@crpd.org I Website: www.crpd.org <br />
