There are already ordinances and state law in place prohibiting smoking in certain park <br />locations. This ordinance clarifies that "vaping" is included in the definition of "smoking" and <br />provides a simpler regulation regarding where smoking is and is not allowed on district property. <br />BACKGROUND <br />Smoking is currently prohibited at certain locations on CRPD park property. The District has <br />prohibited smoking in buildings, within 25 feet of doors or windows to a building, as well as within <br />25 feet of playgrounds for over a decade (per state law). And, by practice, youth sport groups <br />have established no -smoking policies as part of their permit process for adults watching youth <br />sporting events on District fields and outdoor courts. <br />Over the years, state laws have gotten more restrictive, limiting smoking in public areas as the <br />harmful (and offensive to many non-smokers) effects of second-hand smoke have become clear. <br />Many local agencies have curtailed smoking even further —essentially banning it in nearly all <br />public places. (See Attachment 1) <br />The State of California recently passed SB 8 (Glazer) which prohibits smoking from all state park <br />lands and beaches except for parking lots. This law went into effect January 1, 2020.
