Thus, based on the foregoing, staff finds and recommends the board determine that OAKHEART <br />is a usual community event and that there are no "unusual circumstances" presented by the event <br />as proposed (10,000 maximum ticket sales with related off-site parking) which would affect the <br />determination that OAKHEART qualifies for a categorically exemption. <br />DISCUSSION <br />The initial OAKHEART event took place in the summer of 2012 and generated little to no <br />complaints from neighbors. <br />However, noise concerns resulting from the 2013 UAKHEART event were raised by residents <br />and corrections and adjustments have been made to provide a better experience for both the <br />patrons and the surrounding neighborhood, resulting in successful events each year from 2014 <br />to 2019. <br />In an effort to balance the impact of the signiticant financial investments on youth sports <br />improvements to the site with the overall community benefit of OAKHEART, and balancing resident <br />Input and OAKHEART requests, staff has communicated with OAKHEART representatives to <br />discuss the Annual Agreement and Permit Conditions for 2020 OAKHEART. The goal of the <br />discussions was to provide a venue at a reasonable fee while minimizing damage to the sports fields <br />and down time at the site. <br />The attached 2020 OAKHEART Agreement and Permit Conditions is substantially similar to the <br />previous year's agreements. Highlights from the 2020 OAKHEART Agreement and Permit <br />Conditions include: <br />• Event to be conducted Saturday, May 30th, from 1:00 p.m. to 11:00 p.m. (music off at 10:00 <br />P.M.) <br />o set-up days on Thursday, May 28th and Friday, May 29th <br />o clean-up days of Sunday, May 31st, and Monday, June 15t <br />Maximum ticket sales are limited to 10,000, an increase from 9,000 tickets from the <br />previous year. The increased ticket sales will have little to no impact to CRPD property, <br />operations and surrounding properties. <br />Payment to the District is a total of $13,650 as follows: <br />o $2,625 per day at Conejo Creek South (5 days) <br />o $525 per day for parking at Conejo Creek West and Conejo Creek Northwest (one <br />day) <br />Noise levels set at 75 dBA and 90 dBC at property line. Noise to be monitored the day of <br />event and results provided to the District. <br />Each act/performer may experience one (1) violation without penalty. A second violation of <br />any act/performer shall result in a $500 penalty to OAKHEART. A third violation or any <br />subsequent violation of any act/performer shall result in a $1,000 penalty to OAKHEART <br />
